Power of attorney # Power of attorney for property in Dubai: sell or buy A power of attorney for property in Dubai lets a person you trust sell, buy or transfer a named property for you when you cannot be there. Anything left out is outside the agent's authority. | Job | Acts to write into the POA | | --- | --- | | Sell a property | Sell the named unit, agree the price or a minimum price, sign the sale contract, receive the price and give a receipt, hand over keys and papers | | Buy a property | Sign the purchase contract for the named unit, pay the price, accept the title deed, receive keys | | Transfer without a sale | Sign the transfer papers for the named unit to the named person | | Mortgage or release | Sign a mortgage on the named unit, or sign its release, with the lender named | | Gift | Give the named unit to the named person (a gift is also a special act under Article 870) | Use the title deed to copy the unit number, area and owner name. A spelling gap between the POA and the deed is the fastest way to a refusal. ## What the receiving office usually looks at ### Who signed. The office checks that the person named as owner in the POA is the owner on the deed. ### What was given. It reads the acts, so "sell" must be written and not implied. ### How recent the POA is. The Dubai Land Department can apply its own rule on how recent a POA must be for a property deal. UAE law itself sets no general validity period (Article 897), so ask before you choose a term. ### The Arabic text. The instrument is in Arabic. The receiving office decides what it accepts. Your passport, and your Emirates ID if you are a resident. Your agent's Emirates ID, or passport if the agent lives abroad. The buyer's name and ID, if you know the buyer. Questions ## Questions about property power of attorney ### Can my agent sell my property with a POA? Yes, if the POA is special and names the sale of that property. A general POA does not include sale. ### Can I use one POA to buy a property? Yes. Write the buy power, the unit and any price limit. The agent can then sign the purchase for you. ### Does a property POA expire after two years? UAE law sets no general period. The Dubai Land Department can apply its own rule on how recent a POA must be for a property deal, so we check with it before you choose a term. ### Can the agent take a mortgage in my name? Only if the POA names the mortgage act and the lender. Mortgage is one of the acts that needs a special agency. ### Can I cancel a property POA before the sale?
